Workplace Bullying - Employers' Legal Duties

Under the Health and Safety at Work Act, ALL employers have a legal obligation to ensure the health, safety and welfare of their employees.

This includes protection from harassment and bullying work.

Employers are also required, under the Management of Health and Safety at Work Regulations, to conduct risk assessments into the nature and scale of risks to workplace health and safety; to ensure proper measures in place; and to act to avoid, remove or reduce these risks wherever possible

The Health and Safety Executive also specifically states that “there should be systems in place to deal with interpersonal conflicts such as bullying and harassment”.
